Mishpatiem

Weekly reading: Mishpatim Ex 21:1-24:18
Haftorah: Jer 34:8-34:22; 33:25-26
Suggested HaBerith HaChadashah Reading: Mt 5:38-42; 17:1-11

Exo 21:1-36  “These are the right-rulings which you are to set before them:
2  “When you buy a Heḇrew servant, he serves six years, and in the seventh he goes out free, for naught.
3  “If he comes in by himself, he goes out by himself; if he comes in married, then his wife shall go out with him.
4  “If his master has given him a wife, and she has borne him sons or daughters, the wife and her children are her master’s, and he goes out by himself.
5  “And if the servant truly says, ‘I love my master, my wife, and my children, let me not go out free,’
6  then his master shall bring him before Elohim, and shall bring him to the door, or to the doorpost, and his master shall pierce his ear with an awl. And he shall serve him forever.
7  “And when a man sells his daughter to be a female servant, she does not go out as the male servants do.
8  “If she is displeasing in the eyes of her master who has engaged her to himself, then he shall let her be ransomed. He shall have no authority to sell her to a foreign people, because of him deceiving her.
9  “And if he has engaged her to his son, he is to do to her as is the right of daughters.
10  “If he takes another wife, her food, her covering, and her marriage rights are not to be diminished.
11  “And if he does not do these three for her, then she shall go out for naught, without silver.
12  “He who strikes a man so that he dies shall certainly be put to death.
13  “But if he did not lie in wait, but Elohim delivered him into his hand, then I shall appoint for you a place where he is to flee.
14  “But when a man acts presumptuously against his neighbour, to kill him by treachery, you are to take him even from My altar to die.
15  “And he who smites his father or his mother shall certainly be put to death.
16  “And he who kidnaps a man and sells him, or if he is found in his hand, shall certainly be put to death.
17  “And he who curses his father or his mother shall certainly be put to death.
18  “And when men strive together, and one smites the other with a stone or with his fist, and he does not die but is confined to his bed,
19  if he rises again and walks about outside with his staff, then he who smote him shall be innocent. He only pays for lost time and sees to it that he is completely healed.
Second
20  “And when a man smites his male or female servant with a rod, so that he dies under his hand, he shall certainly be punished.
21  “But if he remains alive a day or two, he is not punished; for he is his property.
22  “And when men strive and they shall smite a pregnant woman, and her children come out, yet there is no injury, he shall certainly be punished accordingly as the woman’s husband lays upon him. And he shall give through the judges.
23  “But if there is injury, then you shall give life for life,
24  eye for eye, tooth for tooth, hand for hand, foot for foot,
25  burn for burn, wound for wound, lash for lash.
26  “And when a man smites the eye of his male or female servant, and destroys it, he is to let him go free for the sake of his eye.
27  “And if he knocks out the tooth of his male or female servant, he is to let him go free for the sake of his tooth.
28  “And when an ox gores a man or a woman to death, then the ox shall certainly be stoned, and its flesh is not eaten, and the owner of the ox is innocent.
29  “However, if the ox was previously in the habit of goring, and its owner has been warned, and he has not kept it confined, so that it has killed a man or a woman, the ox is stoned and its owner also is put to death.
30  “If a sin-covering is laid upon him, then he shall give the ransom of his life, whatever is laid on him.
31  “Whether it has gored a son or gored a daughter, according to this right-ruling it is done to him.
32  “If the ox gores a male or female servant, he is to give to their master thirty sheqels of silver, and the ox is stoned.
33  “And when a man opens a pit, or if a man digs a pit and does not cover it, and an ox or a donkey falls in it,
34  the owner of the pit is to repay, he is to give silver to their owner, and the dead beast is his.
35  “And when the ox of a man smites the ox of his neighbour and it dies, then they shall sell the live ox and divide the silver from it, and also divide the dead ox.
36  “Or if it was known that the ox was previously in the habit of goring, and its owner has not kept it confined, he shall certainly repay ox for ox, while the dead beast is his.

Exo 22:1-31  “When a man steals an ox or a sheep, and shall slaughter it or sell it, he repays five cattle for an ox and four sheep for a sheep.
2  “If the thief is found breaking in, and he is smitten so that he dies, there is no guilt for his bloodshed.
3  “If the sun has risen on him, there is guilt for his bloodshed, he shall certainly repay. If he has not the means, then he shall be sold for his theft.
Thirth
4  “If the theft is indeed found alive in his hand, whether it is an ox or donkey or sheep, he repays double.
5  “When a man lets a field or vineyard be grazed bare, and lets loose his livestock, and it feeds in another man’s field, he repays from the best of his own field and the best of his own vineyard.
6  “When fire breaks out and spreads to thorn bushes, so that stacked grain, or standing grain, or the field is consumed, he who kindled the fire shall certainly repay.
7  “When a man gives silver or goods to his neighbour to guard, and it is stolen out of the man’s house, if the thief is found, he repays double.
8  “If the thief is not found, then the master of the house shall be brought before Elohim to see whether he has put his hand into his neighbour’s goods.
9  “For every matter of transgression, for ox, for donkey, for sheep, for garment, or for whatever is lost which another claims to be his, let the matter of them both come before Elohim. And whomever Elohim declares wrong repays double to his neighbour.
10  “When a man gives to his neighbour a donkey, or ox, or sheep, or any beast to watch over, and it dies, or is injured, or is driven away while no one is looking,
11  let an oath of יהוה be between them both, that he has not put his hand into his neighbour’s goods. And the owner of it shall accept that, and he does not repay.
12  “But if it is indeed stolen from him, he repays to its owner.
13  “If it is torn to pieces, then let him bring it for evidence, he does not repay what was torn.
14  “And when a man borrows from his neighbour, and it is injured or dies while the owner of it is not present, he shall certainly repay.
15  “But if its owner was with it, he does not repay. If it was hired, he is entitled to the hire.
16  “And when a man entices a maiden who is not engaged, and lies with her, he shall certainly pay the bride-price for her to be his wife.
17  “If her father absolutely refuses to give her to him, he pays according to the bride-price of maidens.
18  “Do not allow a practiser of witchcraft to live.
19  “Anyone lying with a beast shall certainly be put to death.
20  “He who slaughters to a mighty one, except to יהוה only, is put under the ban.
21  “Do not tread down a sojourner or oppress him, for you were sojourners in the land of Mitsrayim.
22  “Do not afflict any widow or fatherless child.
23  “If you do afflict them at all – if they cry out to Me at all, I shall certainly hear their cry,
24  and My wrath shall burn and I shall slay you with the sword, your wives shall be widows and your children fatherless.
25  “If you do lend silver to any of My people, the poor among you, you are not to be like one that lends on interest to him. Do not lay interest on him.
26  “If you take your neighbour’s garment as a pledge at all, you are to return it to him before the sun goes down.
Fourth
27  “For that is his only covering, it is his garment for his skin. What does he sleep in? And it shall be that when he cries to Me, I shall hear, for I show favour.
28  “Do not revile Elohim, nor curse a ruler of your people.
29  “Do not delay giving your harvest and your vintage. Give Me the first-born of your sons.
30  “Likewise you are to do with your oxen, with your sheep. It is to be with its mother seven days. On the eighth day you give it to Me.
31  “And you are set-apart men to Me, and you do not eat any meat which is torn to pieces in the field, you throw it to the dogs.

Exo 23:1-33  “Do not bring a false report. Do not put your hand with the wrong to be a malicious witness.
2  “Do not follow a crowd to do evil, nor bear witness in a strife so as to turn aside after many, to turn aside what is right.
3  “And do not favour a poor man in his strife.
4  “When you meet your enemy’s ox or his donkey going astray, you shall certainly return it to him.
5  “When you see the donkey of him who hates you lying under its burden, you shall refrain from leaving it to him, you shall certainly help him.
Fifth
6  “Do not turn aside the right-ruling of your poor in his strife.
7  “Keep yourself far from a false matter, and do not kill the innocent and the righteous, for I do not declare the wrong right.
8  “And do not take a bribe, for a bribe blinds the seeing one and twists the words of the righteous.
9  “And do not oppress a sojourner, as you yourselves know the heart of a sojourner, because you were sojourners in the land of Mitsrayim.
10  “And for six years you are to sow your land, and shall gather its increase,
11  but the seventh year you are to let it rest, and shall leave it, and the poor of your people shall eat. And what they leave, the beasts of the field eat. Do the same with your vineyard and your oliveyard.
12  “Six days you are to do your work, and on the seventh day you rest, in order that your ox and your donkey might rest, and the son of your female servant and the sojourner be refreshed.
13  “And in all that I have said to you take heed. And make no mention of the name of other mighty ones, let it not be heard from your mouth.
14  “Three1 times in the year you are to observe a festival to Me: Footnote: 1The Festivals of יהוה are grouped in three, for three different times of the year.
15  “Guard the Festival of Unleavened Bread. Seven days you eat unleavened bread, as I commanded you, at the time appointed in the month of Aḇiḇ – for in it you came out of Mitsrayim – and do not appear before Me empty-handed;
16  and the Festival of the Harvest, the first-fruits of your labours which you have sown in the field; and the Festival of the Ingathering at the outgoing of the year, when you have gathered in the fruit of your labours from the field.
17  “Three times in the year all your males are to appear before the Master יהוה.
18  “Do not offer the blood of My slaughtering with leavened bread, and the fat of My offering shall not remain until morning.
19  “Bring the first of the first-fruits of your land into the House of יהוה your Elohim. Do not cook a young goat in its mother’s milk.
Sixth
20  “See, I am sending a Messenger before you to guard you in the way and to bring you into the place which I have prepared.
21  “Be on guard before Him and obey His voice. Do not rebel against Him, for He is not going to pardon your transgression, for My Name is in Him.
22  “But if you diligently obey His voice and shall do all that I speak, then I shall be an enemy to your enemies and a distresser to those who distress you.
23  “For My Messenger shall go before you and shall bring you in to the Amorites and the Ḥittites and the Perizzites and the Kenaʽanites and the Ḥiwwites and the Yeḇusites, and I shall cut them off.
24  “Do not bow down to their mighty ones, nor serve them, nor do according to their works, but without fail overthrow them and without fail break down their pillars.
25  “And you shall serve יהוה your Elohim, and He shall bless your bread and your water. And I shall remove sickness from your midst.
Seventh
26  “None shall miscarry or be barren in your land. I shall fill the number of your days.
27  “I shall send My fear before you, and cause confusion among all the people to whom you come, and make all your enemies turn their backs to you.
28  “And I shall send hornets before you, which shall drive out the Ḥiwwite, the Kenaʽanite, and the Ḥittite from before you.
29  “I shall not drive them out from before you in one year, lest the land become a waste and the beast of the field become too numerous for you.
30  “Little by little I shall drive them out from before you, until you have increased, and you inherit the land.
31  “And I shall set your border from the Sea of Reeds to the Sea of the Philistines, and from the wilderness to the River, for I shall give the inhabitants of the land into your hand, and you shall drive them out before you.
32  “Do not make a covenant with them nor with their mighty ones.
33  “Let them not dwell in your land, lest they make you sin against Me when you serve their mighty ones, when it becomes a snare to you.”

Exo 24:1-18  And to Mosheh He said, “Come up to יהוה, you and Aharon, Naḏaḇ and Aḇihu, and seventy of the elders of Yisra’ĕl, and you shall bow yourselves from a distance.
2  “But Mosheh shall draw near to יהוה by himself, and let them not draw near, nor let the people go up with him.”
3  And Mosheh came and related to the people all the Words of יהוה and all the right-rulings. And all the people answered with one voice and said, “All the Words which יהוה has spoken we shall do.”
4  And Mosheh wrote down all the Words of יהוה, and rose up early in the morning, and built an altar at the foot of the mountain, and twelve standing columns for the twelve tribes of Yisra’ĕl.
5  And he sent young men of the children of Yisra’ĕl, and they offered burnt offerings and slaughtered peace slaughterings of bulls to יהוה.
6  And Mosheh took half the blood and put it in basins, and half the blood he sprinkled on the altar.
7  And he took the Book of the Covenant and read in the hearing of the people. And they said, “All that יהוה has spoken we shall do, and obey.”
8  And Mosheh took the blood and sprinkled it on the people, and said, “See, the blood of the covenant which יהוה has made with you concerning all these Words.”
9  And Mosheh went up, also Aharon, Naḏaḇ, and Aḇihu, and seventy of the elders of Yisra’ĕl,
10  and they saw the Elohim of Yisra’ĕl, and under His feet like a paved work of sapphire stone, and like the heavens for brightness.
11  Yet He did not stretch out His hand against the chiefs of the children of Yisra’ĕl! And they saw Elohim, and they ate and drank.
12  And יהוה said to Mosheh, “Come up to Me on the mountain and be there, while I give you tablets of stone, and the Torah and the command which I have written, to teach them.”
13  And Mosheh arose with his assistant Yehoshua, and Mosheh went up to the mountain of Elohim.
14  And he said to the elders, “Wait here for us until we come back to you. And see, Aharon and Ḥur are with you. Whoever has matters, let him go to them.”
15  And Mosheh went up into the mountain, and a cloud covered the mountain.
Maftier
16  And the esteem of יהוה dwelt on Mount Sinai, and the cloud covered it for six days. And on the seventh day He called to Mosheh out of the midst of the cloud.
17  And the appearance of the esteem of יהוה was like a consuming fire on the top of the mountain, before the eyes of the children of Yisra’ĕl.
18  And Mosheh went into the midst of the cloud and went up into the mountain. And it came to be that Mosheh was on the mountain forty days and forty nights.

Haftorah: Jer 34:8-34:22; 33:25-26
Jer 34:8-22  The word which came to Yirmeyahu from יהוה, after Sovereign Tsiḏqiyahu had made a covenant with all the people who were at Yerushalayim to proclaim release to them:
9  that everyone was to set free his male and female slave, the Heḇrew man and the Heḇrew woman, no one was to keep a Yehuḏite, his brother, enslaved.
10  And when all the heads and all the people who had come into the covenant heard that each one was to set free his male and female slaves, and not keep them enslaved any longer, they obeyed and released them.
11  But afterward they changed their minds and made the male and female slaves return, whom they had set free, and brought them into subjection as male and female slaves.
12  Therefore the word of יהוה came to Yirmeyahu from יהוה, saying,
13  “Thus said יהוה the Elohim of Yisra’ĕl, ‘I Myself made a covenant with your fathers in the day that I brought them out of the land of Mitsrayim, out of the house of bondage, saying,
14  “At the end of seven years each one should set free his Heḇrew brother, who has been sold to him. And when he has served you six years, you shall let him go free from you.” But your fathers did not obey Me nor incline their ear.
15  ‘And you recently turned and did what was right in My eyes, each man proclaiming release to his neighbour. And you made a covenant before Me in the house which is called by My Name.
16  ‘But you turned back and profaned My Name, and each one of you took back his male and female slaves, whom he had set free, at their pleasure, and brought them into subjection, to be your male and female slaves.’
17  “Therefore thus said יהוה, ‘You have not obeyed Me in proclaiming release, each one to his brother and each one to his neighbour. See, I am proclaiming release to you,’ declares יהוה, ‘to the sword, to the pestilence, and to the scarcity of food! And I shall make you a horror to all reigns of the earth.
18  ‘And I shall give the men who are transgressing My covenant, who have not established the words of the covenant which they made before Me, when they cut the calf in two and passed between the parts of it:
19  the heads of Yehuḏah, and the heads of Yerushalayim, the eunuchs, and the priests, and all the people of the land who passed between the parts of the calf.
20  ‘And I shall give them into the hand of their enemies and into the hand of those who seek their life. And their corpses shall be for food to the birds of the heavens and the beasts of the earth.
21  ‘And I shall give Tsiḏqiyahu sovereign of Yehuḏah and his heads into the hand of their enemies, and into the hand of those who seek their life, and into the hand of the sovereign of Baḇel’s army that has withdrawn from you.
22  ‘See, I am commanding,’ declares יהוה, ‘and shall bring them back to this city, and they shall fight against it and take it and burn it with fire. And I shall make the cities of Yehuḏah a ruin without inhabitant.’ ”

Jer 33:25-26  “Thus said יהוה, ‘If My covenant is not with day and night, and if I have not appointed the laws of the heavens and earth,
26  then I would also reject the descendants of Yaʽaqoḇ and Dawiḏ My servant, so that I should not take of his descendants to be rulers over the descendants of Aḇraham, Yitsḥaq, and Yaʽaqoḇ. For I shall turn back their captivity, and have compassion on them.’ ”

Suggested HaBerith HaChadashah Reading: Mt 5:38-42; 17:1-11
Mat 5:38-42  “You heard that it was said, ‘An eye for an eye and a tooth for a tooth,’
39  but I say to you, do not resist the wicked. But whoever slaps you on your right cheek, turn the other to him also.
40  “And he who wishes to sue you and take away your inner garment, let him have your outer garment as well.
41  “And whoever compels you to go one mile, go with him two.
42  “Give to him who asks of you, and from him who wishes to borrow from you, do not turn away.

Mat 17:1-11  And after six days יהושע took Kĕpha, and Yaʽaqoḇ, and Yoḥanan his brother, and brought them up on a high mountain by themselves,
2  and He was transformed before them, and His face shone like the sun, and His garments became as white as the light.
3  And see, Mosheh and Ěliyahu appeared to them, talking with Him.
4  And Kĕpha answering, said to יהושע, “Master, it is good for us to be here. If You wish, let us make here three booths: one for You, one for Mosheh, and one for Ěliyahu.”1 Footnote:1Mark 9:4.
5  While he was still speaking, see, a bright cloud overshadowed them. And see, a voice came out of the cloud, saying, “This is My Son, the Beloved, in whom I did delight. Hear Him!”
6  And when the taught ones heard, they fell on their faces and were much afraid.
7  But יהושע came near and touched them and said, “Rise, and do not be afraid.”
8  And having lifted up their eyes, they saw no one but יהושע only.
9  And as they were coming down from the mountain, יהושע commanded them, saying, “Do not mention the vision to anyone until the Son of Aḏam is raised from the dead.”
10  And His taught ones asked Him, saying, “Why then do the scribes say that Ěliyahu has to come first?”
11  And יהושע answering, said to them, “Ěliyahu is indeed coming first, and shall restore all matters.1 Footnote:1See Mark 9:12 and Acts 3:21.

Mishpatim Aliya Summary

General Overview: This week's reading, Mishpatim, details many laws, including laws related to slaves, personal injury, loans, usury, and property damage. The end of the portion speaks of the preparations the Israelites made before receiving the Torah at Mt. Sinai.

First Aliyah: This section discusses laws pertaining to the Israelite servant, his mandatory release after six years of service, and the procedure followed when a servant expresses his desire to remain in his master's service. The Torah continues with the laws of the Israelite maidservant, and her terms of release. Other laws contained in this section: a husband's obligations towards his wife; punishments for murder, manslaughter, kidnapping and abusing parents; and the penalties accrued by a person who injures another.

Second Aliyah: This section continues with laws of personal injury: the punishment for one who kills or injures his servant and for one who causes a woman to miscarry. The Torah then shifts its focus to a person's liabilities for damages caused by his possessions, such as an ox that gores; or his actions, such as leaving an open pit uncovered. A person who steals is liable to pay the capital plus punitive damages. The section concludes with a person's right to self-defense when facing a marauding thief.

Third Aliyah: An arsonist is liable for damages caused by fires he ignites. The Torah then details the potential liabilities of an individual who undertakes to be a guardian of another's possessions, a borrower, and a renter. More laws: the punishment for seducing a young woman, sorcery, bestiality and offering an idolatrous sacrifice; prohibitions against harassing a foreigner, widow, or orphan; the mitzvah of lending money to the poor and the prohibition against lending with interest.

Fourth Aliyah: This section, too, introduces us to many new mitzvot: the prohibitions against cursing a judge or leader, consuming meat that was not ritually slaughtered, offering a sacrifice before the animal is eight days old, perjury, and judicial corruption; the commandments to separate all agricultural tithes in their proper order, sanctify the first-born son, return a lost animal to its owner, and help unload an overburdened animal.

Fifth Aliyah: We are commanded not to lie or take a bribe. The mitzvah of the Shemitah (Sabbatical year) is introduced: six years we work and harvest the land, and on the seventh year we allow the land to rest. Similarly, on a weekly basis, six days we work and on the seventh day we – and our cattle and servants – must rest. We are forbidden to mention the name of other gods. We are commanded to celebrate the three festivals — Passover, Shavuot and Sukkot – and to make pilgrimages to the Holy Temple on these occasions. Finally, we are told not to cook meat in (its mother's) milk.

Sixth Aliyah: G‑d informed the Israelites that He would dispatch an angel to lead them into Canaan. This angel would not tolerate disobedience. If, however, the Israelites would hearken to the angel, and eradicate idolatry from the Promised Land, then they will be greatly rewarded. Their Canaanite enemies will fall before them and G‑d "will bless your food and your drink, and will remove illness from your midst."

Seventh Aliyah: This section continues describing the blessings the Israelites will receive if they faithfully serve G‑d: no miscarriages or barren women, longevity, wide spacious borders and supernatural assistance in their quest to conquer the Holy Land. G‑d warns the Israelites against entering into treaties with the Canaanite natives or allowing them to remain in the land after the Israelite invasion. The Torah now relates some of the events that occurred in the days immediately prior to the giving of the Torah. Moses went up the mountain and received a message from G‑d which he communicated to the people. The Israelites enthusiastically committed themselves to following all of G‑d's laws. Moses transcribed the "Book of the Covenant" and read it to the people. Then, together with the Israelite firstborn, Moses offered sacrifices and sprinkled the blood on the people, bringing them into a covenant with G‑d. This section concludes with G‑d summoning Moses – after the giving of the Torah – to ascend the mountain where he would remain for forty days and nights, and would then be given the Tablets.
